Welcome to Splinster. These Terms of Service ("Terms") govern your access to and use of the Splinster website (splinster.in), platform, and associated services (collectively, the "Platform"). Please read these Terms carefully.

1. Acceptance of Terms

Splinster Technologies ("we", "our", or "us") provides an invitation-only marketplace connecting top-tier Artificial Intelligence (AI) and Machine Learning (ML) experts ("Experts") with businesses seeking AI solutions ("Clients"). By accessing the Platform, you represent that you have the authority to bind yourself or the company you represent to these Terms.

2. Eligibility & Accounts

Our platform maintains a high standard of quality through an invitation and verification process.

• Age Requirement: You must be at least 18 years old to use Splinster.
• Account Verification: All Experts and Clients are subject to background, credential, and identity verification. We reserve the right to approve, reject, or revoke access to any account at our sole discretion.
• Account Security: You are responsible for maintaining the confidentiality of your login credentials. You must immediately notify us of any unauthorized use of your account.

3. Platform Rules & Conduct

To maintain a premium ecosystem, users must adhere to strict professional guidelines. You agree NOT to:

• Submit false, misleading, or plagiarized credentials, portfolios, or project requirements.
• Attempt to bypass the Splinster platform to process payments or sign contracts outside of our escrow system after initiating contact through our Platform.
• Harass, abuse, or discriminate against any other user on the Platform.
• Use the Platform to distribute malware, scrape data, or compromise the security of our systems.

4. Fees, Payments & Escrow

Splinster handles financial transactions securely through authorized third-party payment processors (e.g., Stripe).

• For Experts: Splinster charges 0% commission on your earnings. The hourly rate or fixed price you set is exactly what you receive.
• For Clients: Splinster charges a platform fee on top of the Expert's rate, which is clearly disclosed before project funding.
• Escrow System: All project milestones must be fully funded into Splinster Escrow before work begins. Funds are released to the Expert only upon the Client's approval of the milestone deliverable, or following successful dispute resolution.

5. Intellectual Property

The Splinster Platform, including its code, design, matching algorithms, and branding, is the exclusive property of Splinster Technologies.

For work completed on the platform: Unless otherwise agreed upon in writing between the Client and the Expert, all intellectual property rights for delivered and fully paid work transfer entirely to the Client upon the release of escrow funds.

6. Disclaimers & Limitations of Liability

Splinster acts as a marketplace to connect Experts and Clients. We do not direct or control the work performed by Experts.

Disclaimer of Warranties: The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. Splinster does not guarantee the outcome of any project or the specific performance of any Expert.

Limitation of Liability: To the maximum extent permitted by law, Splinster shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Platform, or disputes between Experts and Clients.

7. Account Termination

We may suspend or terminate your account immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Platform will immediately cease.
